PRE-ORDER TERMS & CONDITIONS

Pre-Order Terms & Conditions

By placing a pre-order with PREVAIL BRAND, you agree to the following:

  1. Pre-Order Status
    This is a pre-order purchase. The product is not yet in stock and will ship once production is complete.

  2. Estimated Shipping Window
    Orders are estimated to ship within 4–16 weeks from the date of purchase. Please note that this is an estimate and may vary due to production or shipping delays.

  3. All Sales Final
    All pre-order sales are final and non-refundable. Once an order is placed, it cannot be cancelled, changed, or refunded, except as required by law. Upon request we can exchange the item for an in stock item.

  4. Exceptions Required by Law
    You are entitled to a refund or replacement if:

    • The product is defective, damaged, or not as described, OR

    • The order cannot be fulfilled within the estimated shipping timeframe.

  5. Delivery Updates
    Customers will receive updates via email regarding production and shipping progress.

  6. • Company-Initiated Cancellation: We reserve the right to cancel your pre-order at any time. In such cases, a full refund will be issued to your original payment method or Store credit. 


5. Chargebacks and Dispute Resolution


By placing a pre-order, you acknowledge and agree to the estimated shipping timeframe. Initiating a chargeback without first contacting us to resolve any issues may be considered a breach of this agreement. We are committed to working with you to address any concerns regarding your pre-order.


6. Limitation of Liability


We are not liable for any incidental, special, or consequential damages arising from delays in shipping your pre-ordered item. Our maximum liability is limited to the amount paid for the pre-ordered product.


7. Acknowledgment and Acceptance

 By placing a pre-order with us, you acknowledge that you have read, understood, and agreed to these Terms and Conditions.
